1. Acceptance of Terms
Welcome to Moonvest ("we," "us," or "our"). By accessing or using the Moonvest mobile application or website (collectively, the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
2. No Financial Responsibility
Moonvest is not responsible for any financial decisions you make based on the information, tools, or educational content provided in the App. You are solely responsible for your investment choices, and any resulting gains or losses are your own. The App is intended for educational purposes, and we do not endorse or recommend any specific securities or trading strategies.
3. Service Description
Moonvest is an educational platform that provides:
- Real-time portfolio tracking
- Trading tournaments with potential prizes
- Educational content about stock market investing
- AI-assisted company research tools
- Q&A format learning materials
- Optional tipping of other users whose content you find valuable
4. Account Registration
To use Moonvest, you must sign in using your Apple ID. You agree to provide accurate and complete information and to keep this information updated. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.
5. Trading Tournaments
Trading tournaments are simulated environments for educational purposes only. Prizes, if any, are subject to specific tournament rules and conditions. Tournament participation does not guarantee winning or learning outcomes. We reserve the right to modify, suspend, or terminate tournaments at our discretion.
6. Tips and Creator Payments
Moonvest may allow you to send voluntary monetary tips ("Tips") to other users who have enabled the feature ("Creators"). Tips are currently available only through the Moonvest website and are not available in the mobile application. By using this feature, you acknowledge and agree to the following:
- Voluntary and Non-Refundable. Tips are voluntary expressions of appreciation for a Creator's content or contributions. Tips are not payment for financial advice, investment recommendations, goods, or services. All Tips are final and non-refundable once sent, except where required by applicable law.
- Payment Processing. Tips are processed by Stripe, Inc. ("Stripe"). By sending a Tip, you also agree to Stripe's terms and policies. You authorize Moonvest and Stripe to charge your selected payment method for the full amount of the Tip.
- Platform Fee. Moonvest retains a platform fee from each Tip to cover payment processing and operating costs, with the remainder transferred to the Creator. The applicable fee is disclosed in-app at the time of tipping.
- Creator Payouts. Creators who receive Tips do so through a Stripe connected account and are subject to Stripe's Connected Account Agreement. Creators are solely responsible for any taxes owed on Tips received and for providing any information Stripe requires for payouts.
- No Guarantees. Sending a Tip does not entitle the sender to any specific response, content, service, or benefit from the Creator. Creators are under no obligation to reciprocate in any way.
- Disputes and Chargebacks. If you believe a Tip was sent in error or charged incorrectly, you agree to contact Moonvest at contact@elwynn.io before initiating a chargeback with your card issuer. Initiating a chargeback for a voluntary Tip you intentionally sent is a breach of these Terms and may result in account suspension and recovery of related costs, including chargeback fees.
- Eligibility. To send or receive Tips, you must be at least 18 years of age and authorized to use the payment method you provide. Moonvest reserves the right to limit, suspend, or refuse the Tips feature at its sole discretion.
7. Educational Content
The content provided through Moonvest is for educational and informational purposes only. It does not constitute financial advice, and should not be construed as such. Users should conduct their own research and consult with qualified financial advisors before making investment decisions.
The AI companion provides research assistance and insights based on available data. These insights are not guaranteed to be accurate or complete and should not be the sole basis for investment decisions.
9. Disclaimer of Warranties
The App is provided "as is" and "as available" without any warranties of any kind. We do not guarantee that the App will be uninterrupted, secure, or error-free.
10. Limitation of Liability
To the maximum extent permitted by law, Moonvest shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App.
11. User Conduct
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to the App
- Manipulate tournament results or gaming mechanics
- Share account credentials with others
- Upload malicious content or code
- Initiate fraudulent chargebacks or payment disputes for Tips or other transactions you intentionally authorized
- Use the Tips feature to launder funds, evade taxes, or otherwise violate applicable financial laws
12. Intellectual Property
All content, features, and functionality of the App are owned by Moonvest and are protected by intellectual property laws.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.
14. Termination
We reserve the right to terminate or suspend your account and access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
16. Group Chats and the Moonvest API
Messages you post in a group chat can be read by the members of that group. Moonvest also offers a paid Moonvest API subscription, which has its own terms (the "Moonvest API Subscription Terms") shown on the Developer page when you subscribe. By posting in a group, you acknowledge and agree to the following:
- Members Can Receive Group Messages Through the API. Any member of a group who has a Moonvest API subscription can receive the messages posted in that group, including yours, through the Moonvest API, and can keep copies of them. This applies to public, private and subscriber-only groups.
- Direct Messages Are Never Included. Direct (one-on-one) messages are never sent through the Moonvest API.
- Recalled Messages. When you recall a message, Moonvest tells API subscribers to delete it, and the Moonvest API Subscription Terms require them to. Moonvest cannot guarantee that every copy a subscriber has already received is deleted.
- Personal Use Only. Subscribers may use what they receive for their personal use only, and may not share, resell or republish it.
Do not post anything in a group that you would not want the other members of that group to keep.
